Terms of Service
Welcome to Hermes. These Terms of Service (“Terms”) are an agreement between you and Hermes (“we,” “us,” or “our”) governing your use of the Hermes mobile application and the website at www.hermesdecode.com (together, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. Who can use Hermes
You must be at least 16 years old to use the Service. By using Hermes, you confirm that you meet this requirement and that the information you provide about yourself is accurate.
2. What Hermes is
Hermes is a tool for self-reflection inspired by depth psychology, dream work, synchronicity, and astrology. It helps you record dreams and meaningful moments, calculate your natal chart and transits, converse with AI “companions,” and receive personalized interpretations and insights drawn from your own material.
3. Your account
- You are responsible for keeping your login credentials secure and for all activity under your account.
- Notify us promptly at dreams@hermesdecode.com if you suspect unauthorized use of your account.
- You may delete your account at any time. We may suspend or terminate accounts that violate these Terms.
4. Your content
The dreams, synchronicities, journal entries, messages, and other material you create in Hermes are yours. We do not claim ownership of your content.
To operate the Service, you grant us a limited, non-exclusive license to store, process, and display your content back to you, and to transmit the necessary portions to our AI and infrastructure providers solely to generate your interpretations and run the Service. This license exists only to provide Hermes to you and ends when you delete the content or your account, except for residual backup copies as described in our Privacy Policy.
You are responsible for the content you submit and confirm you have the right to share it.
5. Acceptable use
When using Hermes, you agree not to:
- Break the law or infringe anyone’s rights;
- Upload content that is unlawful, abusive, harassing, hateful, or that violates another person’s privacy;
- Misuse the social features to harass, impersonate, or harm other users;
- Attempt to access accounts, data, or systems that aren’t yours;
- Probe, scrape, overload, reverse-engineer, or otherwise interfere with the Service or its security;
- Use the Service to build a competing product or to resell AI outputs at scale.
6. Social features
Hermes offers optional features for connecting with others — friend codes, shared artifacts, relationship (synastry) readings, and synchronicity echoes. Anything you share with another user is shared at your discretion and subject to the permissions you set. Treat other users with respect; we may remove content or restrict access in response to abuse.
There is zero tolerance for objectionable content or abusive behavior. By using Hermes you agree not to post, share, or transmit content that is unlawful, harassing, threatening, hateful, defamatory, sexually explicit, or otherwise objectionable, and not to harass, impersonate, or harm other users. You can report content or another user at any time using the in-app Report control, or by emailing dreams@hermesdecode.com, and you can remove a connection at any time using the in-app Remove control, which immediately stops any further sharing between you. We review every report and will act on objectionable content within 24 hours — removing the content and ejecting the user who provided it where warranted. We may suspend or permanently terminate accounts that violate this policy.
7. AI-generated content
Interpretations and companion replies are generated by artificial intelligence. AI can be inaccurate, inconsistent, or produce unexpected results, and the same entry may yield different readings. You should treat all AI output as imaginative reflection rather than fact, and exercise your own judgment. We are not responsible for decisions you make based on AI-generated content.
8. Intellectual property
The Service itself — including the Hermes name, logo, design, text, software, and original content (excluding your content) — belongs to us or our licensors and is protected by intellectual-property laws. We grant you a personal, non-transferable, revocable license to use the Service for its intended purpose. You may not copy, modify, distribute, or create derivative works of the Service without our permission.
9. Third-party services
Hermes relies on third-party providers (such as OpenAI for AI processing, Expo for notifications, and our hosting provider). Your use of the Service also depends on these providers, and we are not responsible for their acts or omissions. See our Privacy Policy for how data is shared with them.
10. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or that any interpretation will be accurate or suited to your circumstances.
11. Limitation of liability
To the fullest extent permitted by law, Hermes and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of (or inability to use) the Service — even if we have been advised of the possibility of such damages. To the extent liability cannot be excluded, our total aggregate liability for any claim relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim, or USD $50.
12. Indemnification
You agree to indemnify and hold harmless Hermes and its operators from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your content, your use of the Service, or your violation of these Terms or of any law or third-party right.
13. Termination
You may stop using Hermes and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or other users. Sections that by their nature should survive termination — including content license terms already exercised, disclaimers, limitation of liability, and indemnification — will survive.
14. Changes to these Terms
We may update these Terms as the Service evolves. When we make material changes, we’ll update the “Last updated” date above and, where appropriate, notify you in the app. Your continued use of the Service after changes take effect means you accept the revised Terms.
15. Governing law
These Terms are governed by the laws of Spain, without regard to conflict-of-law principles, and any disputes will be subject to the competent courts of Spain. Nothing in this section deprives you of the protection of mandatory consumer-law provisions of the country in which you reside, which continue to apply where required by law.
